Time Limits
1. Personal Injury and Medical Negligence
Most personal injury and medical negligence claims must be issued at court within three years of the date of the accident. For accidents to children the claim must be issued no later than their 21st birthday.
Exceptions do occur for example where for example you did not know you had the injury/disease at the outset in which case the 3 years runs from when you did know or ought to have known you had the injury/disease.
There may be different time limits for accidents overseas or on planes or boats.
If you are not within 3 years we can give you advice. There may still be a way of making your claim.
2. Employment
For employment-related claims, it is essential if you are a serviceperson to submit a redress of complaint to your Commanding Officer within 3 months of the event and if a claim is to be made then for it to be filed with the Employment Tribunals within 6 months of the event. For civilian MOD and NAAFI employees, the time limit is usually 3 months for filing a complaint with the Employment Tribunals
